Terms of Service

1. About these terms

These Terms of Service (the “Terms”) are a legal agreement between you and Comparability Pty Ltd (ACN 654 356 626 / ABN 75 654 356 626), trading as “Restatus” (“Restatus”, “we”, “us”, “our”), and govern your access to and use of the Restatus website and web application at https://restatus.com.au and related services (the “Platform”).

By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

2. What Restatus is (and is not)

Restatus is a community platform. At present it offers:

  • a prediction game, in which members forecast what a listed property will sell for; and
  • a private property tracker, in which you keep your own private notes and price timeline for properties you follow.

A crowd-reporting feature, for recording sale prices announced at public auctions, is planned but is not currently available. These Terms will be updated before that feature is switched on.

Restatus is not, and does not provide:

  • a property valuation, appraisal, or automated valuation model (AVM);
  • official, government, or authoritative sale-price data, or a substitute for it;
  • financial product advice, investment advice, real-estate advice, tax advice or legal advice; or
  • any recommendation to buy, sell, or bid on any property.

Everything shown on the Platform is a crowd estimate or a member forecast, not a verified figure. Predictions are opinions about an uncertain future outcome and are frequently wrong. Confidence bands, ranges and any aggregated figures are indicative crowd signals only, not valuations. You must not rely on anything on the Platform for any financial, legal, bidding or purchasing decision, and should verify against official sources and obtain independent professional advice before acting.

3. Eligibility and accounts

  • You must be at least 18 years old and able to form a binding contract.
  • You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account.
  • Your public identity on the Platform is a handle: a pseudonym by default, which you may change to a username of your choosing. Your real name and email are not shown publicly, though a username you choose may itself reveal your identity.
  • One person may hold one account unless we agree otherwise. Creating multiple accounts to manipulate reputation, rankings or grades is prohibited (section 6).

4. Predictions

  • A “Prediction” is your forecast of what a currently listed property will sell for, submitted while the property is on the market and before any confirmed sale price exists.
  • Predictions are forecasts of an unknown outcome. They are not statements of fact, not valuations, and are expected to be wrong much of the time. They are provided and displayed as a game.
  • When a confirmed sale price for the property is later entered, we score predictions against it and rank predictors. Scores, ranks and any leaderboard standing are indicative and for entertainment, calculated by methods we may change at any time.
  • Predictions must not include the name of any vendor, purchaser, occupant or other individual (see section 6).
  • Predictions carry no monetary stake and no monetary reward (section 7).

5. Private property tracker

  • The tracker lets you keep a private timeline for properties you follow, for example a price guide, an offer, your own estimate, or a sale price, with an optional source, an amount, a date and a short note.
  • These entries are private to you. They are visible only to you, are never published or shared with other members, and are never used in our crowd estimates, rankings, reputation scores or accuracy reconciliation.
  • You can edit or delete any entry, and stop tracking a property (which deletes it and all its notes) at any time.
  • You are responsible for what you record. Do not record information you are not permitted to hold, and do not include content that is unlawful.

6. Your responsibilities for what you submit

You are solely responsible for each Prediction and tracker entry you submit. By submitting one, you represent and warrant that:

  • the information is provided in good faith and is, to the best of your knowledge, accurate and not misleading;
  • you have not included the name of, or other identifying details about, any individual; and
  • the information does not infringe anyone’s rights and is not defamatory, unlawful, or a misuse of confidential information.

There is no free-text commentary, rationale, review or comment feature on the public parts of the Platform, and you must not attempt to insert commentary, opinions about identifiable people, or names into any field.

7. No payments, reputation and access only

  • In this version of the Platform, contribution is rewarded only with reputation and ranking. There are no cash payments, monetary rewards, prizes, entry fees, stakes, paywalls or purchases of any kind.
  • Predictions are a skill-based game with no stake and no payout.
  • Reputation, prediction scores and rankings are calculated by us and are indicative; we may adjust, recalculate or reset them, and we may remove submissions or reputation obtained in breach of these Terms.

8. Prohibited conduct

You must not:

  • submit false, fabricated, or deliberately misleading Predictions;
  • include any person’s name or identifying details, or any confidential, defamatory or unlawful content;
  • collude with others, use multiple or fake accounts, or otherwise coordinate to manipulate prices, grades, reputation or rankings;
  • scrape, harvest, bulk-extract, or resell data from the Platform, or use it to build a competing dataset, except as expressly permitted;
  • interfere with, probe, or attempt to gain unauthorised access to the Platform or its security; or
  • use the Platform for any unlawful purpose or in breach of these Terms.

We may investigate, remove Predictions, adjust or reset reputation and rankings, and suspend or terminate accounts where we reasonably suspect a breach.

9. Disclaimers and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded.

To the maximum extent permitted by law, and subject to those non-excludable guarantees:

  • the Platform and all content (including Predictions, scores, ranges, rankings and estimates) are provided “as is” and “as available”, without warranties of any kind;
  • we do not warrant that the Platform, or any figure on it, will be accurate, complete, current, uninterrupted, secure or error-free; and
  • you use the Platform and rely on any information at your own risk.

Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data, or loss arising from your reliance on any Prediction, score, ranking or estimate, or from decisions made in connection with buying, selling or bidding on property.

11. Complaints, correction and takedown

We provide an accessible complaints, correction and takedown process. If you believe information on the Platform is inaccurate, identifies you or another person, was submitted in breach of these Terms, or otherwise should be removed or corrected, contact us at privacy@restatus.com.au. We will acknowledge your request and take reasonable steps to review and, where appropriate, remove or correct the information promptly.

12. Intellectual property and licence to your content

  • The Platform, and all software, design, text and materials we provide, are owned by us or our licensors and protected by law. We grant you a limited, revocable, non-exclusive licence to use the Platform for its intended purpose.
  • You retain any rights you have in the content of your Predictions. You grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to host, store, use, reproduce, adapt, publish, display and distribute your Predictions and derived data (such as aggregated estimates, ranges, grades and rankings) for the purpose of operating, promoting and improving the Platform. Your private tracker entries are not published and are used only to provide the tracker to you.

13. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

14. Third-party services

The Platform relies on third-party services (for example, address lookup, hosting and authentication). We are not responsible for third-party services, and your use of them may be subject to their own terms.

15. Indemnity

You agree to indemnify us against claims, losses and costs arising from your breach of these Terms, your Predictions, or your misuse of the Platform, to the extent permitted by law and except to the extent caused by us.

16. Suspension and termination

  • You may stop using the Platform and close your account at any time.
  • We may suspend or terminate your access, remove content, or withdraw the Platform, at any time, including immediately where we reasonably believe you have breached these Terms or to protect the Platform, other members or third parties.
  • Sections that by their nature should survive termination (including content licences, disclaimers, liability limits and indemnities) will survive.

17. Changes to the Platform and these Terms

We may change the Platform or these Terms from time to time. The current Terms will always be available on the Platform, and we will update the “Last updated” date. Material changes will be notified where appropriate; your continued use after changes take effect means you accept them.

18. Governing law

These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
